De acordo com a denúncia do Ministério Público de Santa
Catarina, réu não se conformou com o fim do relacionamento e perseguiu a
ex-companheira no trânsito até conseguir arremessá-la no chão, assumindo o
risco de matar, o que caracteriza dolo eventual. Pena foi fixada em oito anos e
nove meses de reclusão por tentativa de homicídio e três meses de detenção por
descumprimento de medida protetiva.
Segundo o Código Penal brasileiro, quem assume
conscientemente o risco de matar outra pessoa comete o chamado dolo eventual e
sujeita-se a enfrentar o Tribunal do Júri. Foi exatamente o que um morador de
Caçador fez por não se conformar com o fim do relacionamento. Na noite de 7 de
agosto de 2020, ele descumpriu uma medida protetiva e perseguiu a moto da
ex-companheira em alta velocidade até alcançá-la e arremessá-la no chão.
Câmeras de segurança registraram o momento da batida e ele foi denunciado pelo
Ministério Público de Santa Catarina.
Quase quatro anos depois, o Tribunal do Júri julgou e
condenou o réu por tentativa de homicídio com duas qualificadoras - feminicídio
e motivo torpe. A pena foi fixada em oito anos e nove meses de reclusão em
regime inicial fechado. Ele também foi sentenciado a três meses de detenção por
descumprir uma medida protetiva. Segundo consta nos autos, a vítima e o réu
foram casados por 16 anos e têm um filho juntos.
O julgamento aconteceu no fórum de Caçador na última
sexta-feira, 7. A acusação foi conduzida pelo Promotor de Justiça André
Ghiggi Caetano da Silva. Durante uma hora e meia, ele apresentou aos jurados as
provas do crime e as motivações do réu. Depois, usou a réplica para desmantelar
as tentativas da defesa de minimizar os efeitos do crime.
"Felizmente a vítima sobreviveu, mas a atitude do homem
não pode cair no esquecimento, por isso ele foi condenado. Esperamos que o
desfecho desse julgamento mostre à sociedade que o dolo eventual é passível de
punição, e quem assume o risco de matar tem que pagar por isso", diz o
Promotor de Justiça.
